The AmLaw Daily has reported that the Arbitration Institute of the Stockholm Chamber of Commerce has determined that it has the jurisdiction to hear a case from four Spanish investment funds against the Russian government for losses stemming from the expropriation of YUKOS.
The court determined that it had the jurisdiction to hear the case as "the dispute fell within the scope of the arbitration clause of the bilateral investment treaty between Spain and Russia."
The arbitration will be heard by a three-judge panel.
