Mr. Mikhail Vilyavin is former minority shareholder of YUKOS and Yuganskneftegaz.
Testimony Summary:
Mr. Vilyavin testified that he purchased YUKOS shares in 1996 as part of the first privatization auction. He was paid dividends and did not allege that he was paid less or not on time, as compared to other shareholders.
Mr. Vilyavin, who is recognized by investigation as a victim and a civil claimant in case #18/41-03, was unable to explain to the court whose specific actions cause him harm and resulted in his being recognized a victim. His answer was that the harm to him was caused by the YUKOS bankruptcy, resulting in the loss of all YUKOS shares. Asked whether he knew what Messrs. Khodorkovsky and Lebedev were accused of, Mr. Vilyavin replied that he read in newspapers it was "for stealing some crude oil."
Mr. Vilyavin was never told by investigators that he was being questioned as a victim and he never, on his own initiative, wrote a request to be recognized a victim. This came from Mr. Vilyavin's answer before Judge Danilkin acted fast enough to strike the question.
Mr. Vilyavin testified that he never filed any lawsuits against YUKOS or its Board from 1996 through 2006. Mr. Vilyavin confirmed that when he saw Mr. Khodorkovsky speak at YUKOS General Shareholders Meetings, he understood that Mr. Khodorkovsky was the head of YUKOS. Mr. Khodorkovsky never attempted to conceal this fact when meeting with YUKOS shareholders.
